Cattany <br />12450 Washington Street Division Director <br /> <br />Thornton, CO 80241-2405 Natural Resource Trustee <br /> <br />RE: DRMS File M-2007-087; Albert Frei and Sons, Inc., 112 Reclamation Permit Application <br />for the Priola Pit, Adams County <br />Dear Ms. Hunt: <br />The Colorado Division of Reclamation, Mining & Safety (Division) thanks you for your letter <br />dated February 25, 2008 stating your concerns regarding the proposed Priola Pit. <br />The Division appreciates your concerns, but it is unclear from your letter whether the City of <br />Thornton (Thornton) desires designation as an official objector of the project. If Thornton does <br />intend to be designated as an official objector, and therefore obtain party status, additional steps <br />are involved. These include, but are not limited to, providing you with additional information <br />concerning your rights and responsibilities as an official objector and scheduling this matter for a <br />public hearing before the Mined Land Reclamation Board. <br />Please advise the division in writing as to your intentions in this matter as soon as possible to <br />allow us to take the appropriate steps to meet the specified decision date of March 28, 2008 for <br />this application. Therefore, if we do not hear from you in writing by March 21, 2008 stating that <br />you do not wish to be an official objector, we will assume that City of Thornton does wish to be <br />designated as an official objector to the project, and will proceed accordingly. <br />If you have any questions you may call me at 303-866-3927. <br />S'ncerely, <br />1 <br />David A.
