New Horizon Mine March 4, 2008 <br />that would be held in the New Horizon Mine area. As with technical revisions you can <br />object to our proposed decision when it is published and request a hearing before the <br />Mined Land Reclamation Board. Additionally, if the permit revision requests a change to <br />the post-mining land use, Rule 2.05.5(1)(b) requires the Division to obtain written <br />comments from the legal or equitable owner of record of the surface of the proposed <br />permit area. <br />Mike Boulay and Marcia Talvitie did conduct an inspection of the New Horizon Mine <br />last Friday February 29, 2008 and observed the topsoil handling practices. They felt <br />WFC is starting to implement the two-lift topsoil salvage plan as discussed in the <br />February 15, 2008 meeting. Based on this inspection they did not believe a violation had <br />occurred. We will continue to monitor this closely. <br />Lastly, Rule 5.02.5 allows citizens who believe there is a violation of the Colorado <br />Surface Coal Mine Reclamation Act, the Regulations or a permit condition may request <br />the Division to conduct an inspection for violations. The request for an inspection must <br />be in writing and provide sufficient basis to believe that a violation exists.
