New Horizon Mine March 4, 2008
that would be held in the New Horizon Mine area. As with technical revisions you can
object to our proposed decision when it is published and request a hearing before the
Mined Land Reclamation Board. Additionally, if the permit revision requests a change to
the post-mining land use, Rule 2.05.5(1)(b) requires the Division to obtain written
comments from the legal or equitable owner of record of the surface of the proposed
permit area.
Mike Boulay and Marcia Talvitie did conduct an inspection of the New Horizon Mine
last Friday February 29, 2008 and observed the topsoil handling practices. They felt
WFC is starting to implement the two-lift topsoil salvage plan as discussed in the
February 15, 2008 meeting. Based on this inspection they did not believe a violation had
occurred. We will continue to monitor this closely.
Lastly, Rule 5.02.5 allows citizens who believe there is a violation of the Colorado
Surface Coal Mine Reclamation Act, the Regulations or a permit condition may request
the Division to conduct an inspection for violations. The request for an inspection must
be in writing and provide sufficient basis to believe that a violation exists. Further details
of this process are provided in the Rule.
Please call me if you have any questions at 303-866-4927.
Sincerely,
~~
Sandra L. Brown
Sr. Environmental Protection Specialist
c. Ross Gubka
Marcia Talvitie
