(Page 4) <br />MINE ID # OR PROSPECTING ID # M-1999-120 <br />INSPECTION DATE 02/28/08 <br />INSPECTOR'S INITIALS ESC <br />The following problems (PB) and/or possible violations (PV) (and suggested corrective <br />actions) were identified during this inspection. The problems should be corrected by the <br />dates given, or they will become possible violations. The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land <br />Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />DATE <br />1. PROBLEM: <br />The operator has installed a number of topsoil and overburden <br />piles along the west bank of the river. The piles range in <br />height from 4 feet to nearly 15 feet. In accordance with Rule <br />3.1.9, topsoil stockpiles shall be stored in places and <br />configurations to minimize erosion and located in areas where <br />disturbance by ongoing mining operations will be minimized. <br />CORRECTIVE ACTION: <br />The operator will need to remove/relocate all piles that were <br />not previously approved by the Division as stockpile locations <br />on or before April 1, 2008 and submit documentation of <br />compliance in the form of photographs by April 15, 2008. As an <br />alternative, the operator may submit a revision to the Division <br />demonstrating that the stockpiling of berms and topsoil piles <br />will not have any affect on the routing of floodwaters. Such <br />revision must be submitted by March 17, 2008 and implemented on <br />or before April 1, 2008. <br />2• PROBLEM: <br />The Fort Lupton Sand and Gravel Mine is within the 100-year flood <br />plain of the South Platte River. The eastern edged of the pit is <br />approximately 200 feet from the South Platte River and the approved <br />mining and reclamation plan does not address how flood waters will <br />be safely passed in the event of a flood. In accordance with Rule <br />3.1.6 disturbances to the prevailing hydrologic balance of the <br />affected land and of the surrounting area shall be minimized. <br />CORRECTIVE ACTION: <br />LG Everist will need to demonstrate that the lined pits will safely <br />pass the 100-year flood event in the form of a revision to the <br />permit on or before June 1, 2008. <br />PB or PV:PB <br />TOPIC(S):TS <br />4/1/2008 <br />PB or PV:PB <br />TOPIC(S):HB <br />6/1/2008 <br />
