ROBINSON <br />J.ERICH RAUBER, P.E. <br />Please find enclosed two (2) copies of the Technical Report Addressing Request for Site-Specific <br />Points of Compliance and Ground Water Classification for Bowie No. 2 Mine. <br />The goals of this report are to establish site-specific points of compliance at the Bowie No. 2 <br />long wall coal mine, which exclude monitoring ground waters within the permit area and to <br />obtain asite-specic ground water classification of "Limited Use and Quality" for ground water <br />within the permit ~rrea. <br />We respectfully submit, and our opinion is the establishment of a point of compliance as <br />currently suggested by the Colorado Division of Reclamation Mining Safety (DBMS) is <br />technologically iniFeasible and economically unreasonable as defined in DBMS Rule <br />4.05.13(1)(b)(ii). We also submit the suggestion that ground water at the Bowie No. 2 mine <br />meets the regulatory criteria for a classification of "limited use and quality" under Colorado <br />Department of Public Health and Environment Water Quality Control commission Regulation <br />41.4(B)(5). <br />Because of our tec 1 and economic finding, we request the Division waive the requirement <br />to establish undwat compliance monitoring wells for the Bowie Mine.
