DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
January 14, 2008
Ms. Michelle Hatcher
Applegate Group, Inc.
1499 West 120th Avenue, Suite 200
Denver Co 80234-2728
~.
RE: Substitute Water Supply Plan, G.L. Pit, (DRMS# M-81-022) /
NW1/4 Section 3, T7N, R69W, 6th P.M.
Water Division 1, Water District 3, Larimer County
Approval Period: November 1, 2007 through October 31, 2008
Contact Phone Number for Ms. Michelle Hafcher.~ 303-452-6611
Dear Ms. Hatcher:
Bill Ritter, Jr
Governor
Harris D. Sherman
Executive Director
Dick Wolfe, P.E.
Director
~ECEIIiE®
FBB 2 8 2008 /
Division or Keaamation,
Mining and Safety
Your letter' dated September 13, 2007, requesting renewal of the above referenced
substitute water supply plan to cover depletions caused by an existing gravel mining operation has
been reviewed. The required fee of $257 for the renewal of this substitute water supply plan has
been submitted. The original plan was approved on March 26,1993 and was most recently renewed
on October 20, 2006. As indicated in the previous approval letter, Connell Resources, Inc. has
begun the process of backfilling this site above the groundwater table to remove the long-term
augmentation requirement. In a letter dated April 23, 2003, the State Engineer's Office allowed the
site to be operated under a substitute water supply plan until such time that the pit has been
completely backfilled. Connell Resources, Inc. has amended their DMG permit to reflect that the
groundwater pond will be backfilled completely. According to the information provided, no additional
backfilling of the site took place in 2006-2007. Connell Resource, Inc. will continue backfilling the
site when material is available nearby and is cost effective to transport to the site.
Please note that the approval of this substitute water supply plan does not relieve the
Applicant and/or the landowner of the requirement to obtain a water court decree approving
a permanent plan for augmentation or mitigation to ensure the permanent replacement of all
depletions, including long-term evaporation losses and lagged depletions after gravel mining
has ceased. Therefore renewal of this plan is contingent on the Applicant demonstrating that
the backfilling of the site has continued or contingent upon the Applicant filing an application
for a plan for augmentation with the Division 1 Water Court by October 31, 2008 that
includes, long-term evaporation losses at the G. L. Pit site.
The only consumptive use associated with the G.L. pit site will be from evaporation of
exposed groundwater. The current exposed surface area at the G.L. Pit remains at 6.4 acres. Total
estimated annual consumptive use for this plan is 9.8 acre-feet of evaporation from 6.4 acres of
exposed water surface area of which 5.5 acres have a phreatophyte credit. For the 5.5 acres an
evaporative value of 16.76 inches was used. The evaporative depletions from the 5.5 acres are 7.7
acre-feet. The remaining 0.9 acres of the total 6.4 acres exposed at the site create an evaporative
depletion without phreatophyte credit. The evaporative depletions from the 0.9 acres are based on
an evaporative value of 27.36 inches. The evaporative depletions from the 0.9 acres are 2.1 acre-
feet.
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-3581 • Fax: 303-866-3589
www. water.state. co.us
