RULE 2.01.1 - SCOPE

This section establishes [he minimum several requirements for permits required to commence or continue
surface coal mining and reclamation operations. The objectives of this section are to insure that all persons make
timely application for permits, and that all surface coal mining and reclamation operations are conducted onh~
under penni[s issued in accordance with the requirements of the Act and these Rules.

RULE 2.01.2 - GF,NERAL REQUIREMENTS FOR EXISTING OPERATIONS
Not later than two months followine the date of approval of the Colorado regulatory proeram by the
Secretan~, all operators who are conducting and intend to conduct surface coal minine operations cieht months
after such approval, shall file an application for a permit with the division for such operations. The application
shall comply with all applicable provisions of Rules 2 and 4. With regard to the requirements of 2.OS.6(3)(b)(iv),
the application shall he considered filed if it contains all applicable hydrologic information reasonably available [o
the applicant as of the date of the application

RULE 2.01.3 - GENERAL REOUIREMENTS FOR PERMITS FOR ALL SURFACE COAL MINING
AND RECLAMATION OPERATIONS
E~cents as provided for in 2.01.3(21 and 2.OL3(i), on and after eieht months from the date on
which the Colorado regulatory grogram is approved by the Secretary of the Interior, which date is set forth by Rule
of the Board, no person shall conduct, on lands within this State, any surface coal mining and reclamation
operations unless such person has first obtained a valid permit issued under the applicable provisions of these
Rules
21 A person conducting surface coal minine and reclamation operations. under a permit issued or
amended by the Division in accordance with requirements of the "Colorado Mined Land Reclamation Act"
(Section 34-33-101, C.R.S. 1973) and the Rules and Reeulations promulgated therewith and operative in
compliance with Section 502 of the Surface Mining Control and Reclamation Act of 1977 (P.L. 95-87), as
determined by the Division, may conduct these operations beyond [he period prescribed in (I) above if:
(a) A complete application for a permit has been filed with the Division in accordance +vidt
a~~licable provision o1'Rules 2 and 4; and
(b) The Division has not vet rendered an initial decision with respect to such application.
• (3) If prior to [he date of approval by [he Secretary of [he Colorado reeulaton~ prooram, a person has
filed with the Division the application for a permit in compliance with the "Colorado Mined Lnnd Reclamation
