Mud Creek Pit -Reclamation Permit Application -112 (C) Exhibits Page 21 of 67
Holes, etc.
There are no drill holes, auger holes, adits or shafts to reclaim.
Maximum slopes
Slopes of 1V:3H or less, as proposed, are compatible with surrounding conditions and land use. See Table E-1
Permanent industrial areas will either have slopes of 1 V:3H or less, or have retaining structures as needed.
Use of farm equipment
Slopes will be compatible with such use in the area.
Notice of other backfill
The Applicant will comply with this requirement to notify the Division if other backfill is used. Use of clean
construction debris, such as soil, subsoil, waste rock, overburden, clean Portland or asphaltic cement concrete
rubble or waste (as from washout of trucks), for backfill, to be covered by topsoil as appropriate for intended
post-mining use, is proposed. Noacid-bearing materials, tailings, or other toxic or potentially toxic materials
shall be used. When in doubt, standard characterization methods shal- be used to evaluate the suitability of
construction/demolition debris-type materials for use on site. Records of off-site sources of backfill material shall
be maintained for the life of the operation.
Prevention of unauthorized release of pollutants to surface water
The Applicant will handle mined material to be disposed of on-site in a way to prevent unauthorized release of
pollutants to surface water, and comply with this requirement,
Prevention of unauthorized release of pollutants to groundwater
The Applicant will handle material mined, handled, or disposed of on-site in a way to prevent unauthorized
release of pollutants to groundwater, and comply with this requirement.
General water hydrology and water quality
Hydrology and water quality issues are addressed at length in Exhibit B. The Applicant will comply with
applicable water and water rights laws and regulations, and water quality laws and regulations. No dredge or fill
in waters of Colorado or the United States is proposed, and no temporary or large siltation structures will be
placed except as required by permits,9 and will be removed in accordance with those permits.
Earth dams
Mining will be done only in areas which will not present potential for negative impact on the stability of off-site
earth dams (located near NE corner). Except for storm water control systems and ponds for livestock use, there
will be no earth or other dams or basins constructed. Those bermed areas and basins will each contain less
than 10 acre-feet of water and with a total depth of less than 10 feet at any time, including immediately following
24-hour, 25-year storm events, and are therefore non-jurisdictional. Mining is expected to remain well above the
normal ground water table. Rock check dams and incised basins shall be used for sediment and erosion control.
Erosion control
All surfaces will be stabilized and protected to control erosion. Stockpiles of soil and excess fines will be
protected against erosion, traffic, and weed invasion; either by seeding (temporary seed mix or agricultural
products) or application ofdust-control and crusting agents (such as polymers or other soil treatments), wind or
silt fencing. (See Exhibit B for seeding data, Exhibit C for additional stockpile information.)
9 Primarily CDPS storm water permits.
McStone Aggregates, LLC 15 FEB 2008 ©WAST`EL1NE, INC 2008 PN 5006.1-4(009)
