III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This was an aerial inspection of the Blue Flame Mine flown by Harry Ranney on February 19, 2008. Tom <br />Kaldenbach examined digital images on the computer screen. <br />Prior to May 2004 DMG had last conducted reclamation on this site in May 1993. In May 2004, DMG had a <br />subsidence feature at the top of the portal area regraded and a diversion ditch was excavated around the regraded <br />area. DRMS initiated its process of final bond release/termination of regulatory jurisdiction of the Blue Flame <br />Mine on September 11, 2007 and conducted a final bond release inspection November 27, 2007. DRMS issued a <br />proposed decision to approve the termination of jurisdiction on January 29, 2008. <br />The two photos taken during the flight are shown below. The ground was covered with snow. No problems were <br />evident in the photos. No changes are evident in the photos, compared to recent on-ground inspections. <br />
