We <br />have compiled a letter to the Mineral Owners of Public Record per article 65.5 section 24-65.5- <br />103, and the surrounding land owners within 200 feet. I have enclosed copies of the certified <br />mailing receipts, showing the recipients addresses and date the notices were sent out, as required <br />by the Notice Requirements. <br />Section 1, 24-65.5-103 II, (b) Notice requirements states that "If such records do not identify any <br />mineral estate owners, including their addresses of record, the applicant shall be deemed to have <br />acted in good faith and shall not be subject to further obligations under this article. The applicant <br />shall not be liable for any errors or omissions in such records." The importance in this statement <br />is the fact that the source of our public records, Rio Blanco County Assessor's Office, has five <br />mineral owners on record for Tract 39 and Tract 41, and one owner in Tract 38 that are listed on <br />the mineral information books, the only source for mineral ownership within that office. <br />However, these owners and their addresses are not listed in the assessor's database and no <br />information can be found on their addresses through the public records search of that office. <br />Therefore, no mineral notices were sent to those mineral owners. <br />In conclusion, we have reviewed all public records pertaining to the mineral ownerships within <br />these three tracts of land, and there are no public records available showing ownership addresses <br />for these six mineral owners. Therefore, we have acted in good faith and according to the notice <br />requirements, are not subject to further obligations. <br />Sincerely, <br />.~--~ <br />James W. J <br />bak <br />
