Daniel <br />Hernandez will preside as the Pre-hearing Conference Officer. Please find enclosed a copy of the <br />chronology of the Application Process from the Whirlwind Mine application file: <br />ChronoloQV of Permit Process <br />07/26/07 Permit considered complete for review. The application is considered complex under <br />Rule 1.4.1(7) which allows for 150 days of review. The initial decision date is set for <br />December 24, 2007. <br />07/31/07 All notices required by the Division under Rule 1.6.1(2) are sent out. <br />08/09/07 DRMS receives comments from Historical Society. Comments are general in Nature and <br />are not considered an objection. <br />08/31/07 Energy Fuels begins publication in Grand Junction Daily Sentinel per Rule 1.6.2(1) (d). <br />09/21/07 Publication ends after once a week for four (4) consecutive weeks of publication. <br />10/11/07 Information Network for Responsible Mining submits comments. Comments are <br />considered objectionable in nature and thus classified as an objection. Per Rule 1.7(2) (a) <br />the comments are considered timely. <br />10/11/07 Comment period ends on 20th day after last publication. <br />11/15/07 Preliminary Adequacy Review (PAR) issued to Energy Fuels from DRMS. <br />11/29/07 Pre-hearing Conference (PHC) set for December 28, 2007. Formal Public Hearing (FPH) <br />set for January 910, 2008. <br />12/10/07 Energy Fuels request additional time to respond to DRMS PAR. Request is granted to <br />January 14, 2008. <br />12/10/07 Energy Fuels request extension to decision date from December 24, 2007 to January 24, <br />2007.
