(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1992-069 <br />INSPECTION DATE 11116/2007 INSPECTOR'S INITIALS CBM <br />OBSERVATIONS <br />This inspection was performed as part of the Division of Reclamation, Mining and Safety's (DRMS) normal inspection and <br />enforcement program and a request from the operator to inspect an area that was subject to a diesel fuel spill in the past. <br />Operator representatives were present and included Connie Davis and Mike McAfee of Aggregate Industries and Scott <br />Rutherford of Paragon, a consultant to Aggregate Industries. All people met at the site and accompanied the inspector during <br />the inspection. <br />The Division was notified of a diesel fuel spill in 2001. A subsequent inspection and investigation by the operator indicated that <br />approximately 10,800 gallons of diesel was lost via leakage from a refueling tank. The operator responded by installing <br />monitoring wells and excavating some material and adding said material to asphalt plant feed. Also, two technical revisions <br />were submitted and subsequently approved to allow the operator options to handle the problem. Technical revision 3 required <br />excavation of all contaminated material and treatment to eliminate the diesel fuel. Technical revision 4 allowed continued water <br />monitoring and mitigation if all contaminated material was not excavated and treated. Aggregate Industries has chosen to <br />excavate all material and did so. Material was stockpiled southeast of the excavation and below the ultimate water line of the <br />reclaimed pit. This material was partially excavated during the inspection and found to contain a noticeable amount of diesel <br />fuel. The material must be moved out of the area that will be flooded by water prior to final reclamation and photo <br />demonstration that this was done will need to be forwarded to the Division prior to shutting off dewatering pumps for the pit. <br />During the inspection other oil staining of soils not related to the diesel fuel spill was observed. Samples of this soil were taken <br />by Mr. Rutherford of Paragon. Please forward results of sample test to the Division when they become available along with a <br />plan for disposition of the contaminated material before dewatering of the pit is discontinued. <br />Excavated diesel fuel spill area <br />Excavation to left, contaminated material to left-center. <br />
