III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was an aerial inspection of the New Horizon Mine conducted by Harry Ranney of the <br /> DRMS. Aerial photographs were taken on January 31, 2008. Weather conditions were overcast <br /> at the time of the flight. Mike Boulay of the DRMS reviewed the aerial photographs. <br /> Ten photographs were taken during the flyover. Portions of the mine site that were visible in the <br /> photographs were snow covered. Equipment was active in the pit area. It appeared that coal was <br /> being loaded and hauled out of the pit. A drill was visible on the bench at the north end of the <br /> active pit area. No problems were noted in any of the aerial photographs. <br /> Roads <br /> All of the county roads visible in the photographs had been plowed. Most of the mine site roads <br /> in vicinity of the pit area were clear of snow cover and appeared well maintained and in good <br /> condition. All road ditches were snow packed. <br /> Hydrologic Balance <br /> All of the sedimentation ponds (with exception of Pond 009) were visible in the photographs. <br /> Pond 007 was full and iced over except for the southwest corner of the pond. Pond 008 was <br /> retaining water well below the primary spillway and was entirely snow covered. Ponds Ol 1, 012, <br /> and 013 were snow covered but did not appear to be retaining any significant amounts of water. <br /> Pond inlets and embankments appeared stable and no problems were noted at any of these <br /> sediment pond locations. <br /> Support Facilities <br /> The shop, warehouse and storage areas were viewed. The office and shop areas had been cleared <br /> of snow. From the photos, these facilities and perimeter areas of the site appeared to be <br /> maintained and no problems were identified. <br />
