III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br /> supporting the enforcement action. <br /> This was a complete inspection of the Blue Flame Mine conducted by Tom Kaldenbach of the <br /> Colorado Division of Reclamation, Mining and Safety. The mining and reclamation permit for the <br /> Blue Flame Mine was revoked on June 27, 1991. The State holds no reclamation bond associated with <br /> the site. The site is on privately owned lands and coal. Prior to May 2004, DRMS had last conducted <br /> reclamation on this site in May 1993. In early 2004, DRMS initiated the final bond release/termination <br /> of jurisdiction process (file SL-1). In May of that year the IML Program of DRMS, in association with <br /> filling a 1-foot diameter, 5-foot deep hole in the former portal area, had a contractor excavate a <br /> diversion ditch at the top of the portal area. Excavation of the ditch resulted in DRMS suspending its <br /> termination of jurisdiction process for the Blue Flame site. <br /> DRMS re-initiated its process of final bond release/termination of regulatory jurisdiction of the Blue <br /> Flame Mine on September 11, 2007 and conducted a final bond release inspection November 27, 2007. <br /> DRMS issued a proposed decision to approve the termination of jurisdiction on January 29, 2008. <br /> The site was covered with several feet of snow which prevented access. The site was observed at a <br /> distance from County Road 120. No problems were evident on the site. <br /> Availability of Records <br /> None are required, as this is a revoked permit site. I visited the office of the LaPlata County Clerk and <br /> Recorder and verified that the Division's Findings document for the termination of jurisdiction was <br /> available for public review. <br /> Signs and Markers <br /> None are maintained, as this is a revoked permit site. <br /> Roads <br /> As observed on previous inspections, the access roads into the site have been regraded and revegetated. <br /> No problems were evident in these areas during this inspection. <br /> Hydrologic Balance <br /> There are no ponds on the site. The only ditch remaining on the site is the approximate 30-foot long <br /> diversion ditch excavated in May 2004 by DRMS, located above the west side of the former portal <br /> area. This ditch was covered with snow. <br />
