III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 22 January 2008 50-or <br /> Pg 1/6 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br /> The inspection was conducted on 22 and 23 January 2008. Tony Tennyson of CCC <br /> accompanied me on the inspection on 23 January 2008. On the afternoon of 22 <br /> January 2008 there was a meeting between the Division and Colowyo regarding <br /> success standards and other issues pertinent to the upcoming mine plan Technical <br /> Revision (due to the Division no later than 15 March 2008). The meeting notes are <br /> contained under a separate cover. The mine was actively mining coal and hauling <br /> coal to the loadout at the time of the inspection. The weather was very cold (-5o F, <br /> not including the wind-chill) and windy and the ground was covered with snow, with <br /> deeper snows at the higher elevations of the mine. <br /> Signs and Markers: - All of the necessary signs were in place as required at the time <br /> of the inspection. Mine ID signs were in place at the main entrance and at all of the <br /> ponds along Colorado Highway 13 as required. Colowyo has a mine identification <br /> sign at the access point (by the Sturgeon house) along Colorado Highway 13, which <br /> is the access point to the Section 28 Pond. <br /> Roads: - The mine access road and haul road to the Gossard Loadout is a paved <br /> road. The road was wet and icy in spots at the time of the inspection but it was well <br /> maintained and in good condition. <br /> - The light-use road in Taylor Draw to the West Pit Pond, East Taylor Pond and West <br /> Taylor Pond was inaccessible due to snow at the time of the inspection. <br /> - The haul roads in the East and West pit areas were wet, icy and/or covered with <br /> snow in spots but appeared to be well maintained and stable at the time of the <br /> inspection. No erosional problems were noted on these roads. <br /> - The light-use roads around the Gossard Loadout and to the rail loop were icy and <br /> covered with snow but appeared to be well maintained and in good condition at <br /> the time of the inspection. <br /> - The haul roads in the Bower project area (topsoil removal) are well maintained and <br /> appear to be stable. These roads are in the Taylor Draw and along the west edge of <br /> the Section 16 Pit. There is also a new haul road that was constructed just south of <br /> the existing Section 16 Pit. This road is for continued topsoil removal operations in <br /> advance of the mining in the South Taylor area. This road was wet and covered with <br /> ice and snow in areas. The operator was actively working on the road to maintain a <br /> passable condition. <br /> - The light-use roads in the East Pit reclamation area were all more or less inaccessible <br /> due to snow. <br />
