SNOWCAP COAL COMPANY <br />SEDIMENT POND 8 CERTIFICATION <br />In accordance vrith Rule 4.05.9(14), impoundments will be inspected during <br />construction and upon completion of construction by a qualified registered professional <br />engineer or othE;r qualified professional specialist under the direction of a professional <br />engineer. This certification is for the construction of Pond 8 located at the South Portal. <br />The construction of the pond was supervised and inspected numerous times by J. E. <br />Stover, P.E. The final inspection occurred on January 24, 2008. I have a wide variety <br />of experience in the design and construction of earth fill embankments and <br />impoundments. Nothing was observed during the inspections that-would indicate the <br />pond has a pote:ntial for failure. There was no appearance of erosion, instability, <br />structural weakness or other hazardous conditions. There are no required monitoring <br />procedures or instrumentation other than quarterly and yearly inspections. There are <br />no aspects which might affect stability and there is no required maintenance. There <br />was no water imipounded during the final inspection. Pond 8 does not have a primary <br />spillway so dewatering must be done with a portable pump. Pond 8 is a dugout pond <br />so there is no embankment that could fail. <br />The sediment pond was downsized from a capacity of about four acre feet to a capacity <br />of about one acre foot. The pond was filled intermittently during 2007 when the new <br />road was being constructed at the South Portal. The contractor finished with pond <br />construction during January 2008. Design calculations for the sediment pond are in <br />Appendix 13-2 beginning on page RSS-1. The pond is shown in plan view on Exhibit <br />6C-A. The required capacity of the pond is a total of 0.9 acre, 0.22 acre feet of <br />sediment and 0.68 acre feet of water water.
