2. Hubbard Creek was diverted around Pond No. 1 during the mining operation. With <br />the removal of Pond No. 1, Hubbard Creek was restored to its previous channel. The <br />channel did not require major reconstruction. Up to 2,000 cubic yards ofgravel from <br />the pond were used on the reclaimed banks along the creek as additional erosion <br />control. <br />The Division proposes to approve the North Draw permanent diversion. This <br />diversion is consistent with applicable state law, will not diminish downstream water <br />rights and meets the requirements of Rule 4.05.4 (4.05.4(4)). <br />D. SE;dimentation Ponds <br />The Blue Ribbon Mine curently has two sediment ponds, Pond Nos. 4, and 5. <br />Previously, the site contained Pond No. 1, which has been reclaimed and replaced by <br />Pond No. 5, and Pond No. 2, which was eliminated with the bench stabilization <br />project. Pond 3 was transferred to Oxbow Mining's Elk Creek Mine. The ponds have <br />been designed, constructed and maintained in accordance with the requirements of <br />4.05.6 and 4.05.9. The location of these ponds can be found in Exhibit H-1 and <br />Exhibit Z. The ponds are located as near as possible to the disturbed area and are not <br />located within perennial streams according to 4.05.6(1)(6). <br />E. A~~id-forming and Toxic-forming Spoil <br />The Blue Ribbon Mine extracted coal from the E seam, which is an extremely <br />uniform and clean seam. The underground development waste that was produced was <br />placed at the Red Canyon Mine's refuse disposal area. There was minimal waste <br />material and did not require any special handling 4.05.8(3). <br />F. Impoundments <br />Refer to the section regarding sediment ponds (4.05.9) <br />G. Surface and Groundwater Monitoring <br />The applicant will conduct monitoring of ground water in a manner approved by the <br />Division. The ground water monitoring plan is described in Section 2.05.6, <br />Mitigation of the Impact of Mining Operations, page 124, in the permit application <br />(4.05.13(1)). <br />The applicant will conduct monitoring of surface water in a manner approved by the <br />Division.
