Box 68 <br />p P Y Empire, CO 80438 <br />Phone (303) 569-3221 <br />~ ,~ ~ ~ L% Fax (303) 569-2830 <br />11~C~ ~ <br />Allen Sorenson January 22, 2008 <br />Colorado Division of Reclamation, Mining and Safety ~ <br />1313 Sherman Street -Room 215 <br />Denver, Colorado 80203 - / J o) r~ ~ -~ ~ ~ ,~~ <br />Reference: Climax Mine - Tenmile and Mayflower ailing Storage Facilities ~~,~,~,~ ~ ~ ~~ J~,~ .,/~ <br />Dear Allen, Mining ~~d ~ ~~~~ <br />Climax Molybdenum is requesting the Colorado Division of Reclamation, Mining and Safety to review <br />and accept the approach to establish design criteria proposed for the design and construction of the <br />Tenmile and Mayflower Tailing Storage Facilities (TSFs) under the Climax Environmental Protection <br />Plan rules. <br />As you may recall during our meeting with you in August 2007 to update DRMS with the results of the <br />feasibility study, Climax has recently conducted state of the practice engineering analyses to support the <br />design for the TSFs including seismic hazard, seepage, stability, liquefaction potential and settlement. <br />Climax is now in the process of performing detailed design to support the restart of the mine in 2010. <br />Our Engineer for the engineering detailed design work tasks, Smith Williams Consultants, have <br />prepared for us their recommended Seismic Stability approach to establish the design criteria that will be <br />used for the construction and operation of the TSFs.
