<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Jason Musick of the Colorado Division of Reclamation, <br />Mining, and Safety. Bob Steele of New Elk Coal Company accompanied the inspection. No <br />reclamation related activities were being conducted at the time of this inspection. Weather conditions <br />were cloudy and cold with snow falling at the time of the inspection. Ground conditions were snow <br />covered throughout the site at the time of the inspection. <br />Signs and Markers <br />The mine ID sign was is place at the entrance to the site. The sign appeared to be in compliance and <br />no issues were noted. <br />Roads <br />Access roads throughout the site and the light use roads to the ponds appeared to be in excellent <br />condition. The access roads were graded at the time of the inspection although they were still snow- <br />packed. The light-use roads leading to ponds 6, 7, 9 and 9A appeared to be in good condition. These <br />roads were not graded and were snow covered throughout. <br />Hydrologic Balance <br />The diversion ditches on fills 7, 8, and 9 appeared stable and no problems were noted. All ponds <br />were snow covered and water was not clearly noticeable. All embankments appeared stable with no <br />signs of erosion or problems at the time of the inspection. <br />Revegetation <br />The ground was covered throughout by recent and current snowfall at the time of the inspection. <br />Although snow cover was substantial, noticeable vegetation cover was observed throughout the <br />reclaimed areas. There did not appear to be any problems with the reseeded areas of W-1 and W-3 <br />as noted in the January 08 inspection. No revegetation problems or inadequate vegetation were <br />noted at the time of the inspection. <br />Backfilling and Grading <br />There did not appear to be problems with the permanent drainageway which was under construction <br />as noted in the January 08inspection. There were no signs of damage or erosion problems at the time <br />of the inspection. <br />Overall, this site is appeared to be in good condition for the winter season. <br />
