BOx 46667 Division Director Natural Resource Trustee Denver, Colorado 80201-4667 Dear Mr. Atencio: The Colorado Inactive Mines Program is requesting that the Office of Surface Mining extend the Fruita Mine Civil Penalty Grant until.December 31, 2009. We estimate that the cost to complete the reclamation maintenance work will be $50,000.00. We currently hold a Civil Penalty Grant in the amount of $15,000.00. The current grant, in addition to the remaining forfeited bond, leaves us with a total of approximately $17,000 to accomplish the work that is required at the site. Thus we have a funding deficit of approximately $33,000.00. We are requesting that the current Civil Penalty Grant be extended until December 31, 2009, in order that we have time to secure additional sources of funding to make up the projected deficit. Further, experience has shown that fall is the best time of year to work at the Fruita Mine in order that revegetation success potential is maximized. Because we anticipate that the time factor and difficulty in obtaining additional funds may be significant, we feel that it is necessary to plan for reclamation maintenance work to occur in the fall of 2009.
