BOx 46667 Division Director <br />Natural Resource Trustee <br />Denver, Colorado 80201-4667 <br />Dear Mr. Atencio: <br />The Colorado Inactive Mines Program is requesting that the Office of Surface Mining extend the Fruita <br />Mine Civil Penalty Grant until.December 31, 2009. <br />We estimate that the cost to complete the reclamation maintenance work will be $50,000.00. We currently <br />hold a Civil Penalty Grant in the amount of $15,000.00. The current grant, in addition to the remaining <br />forfeited bond, leaves us with a total of approximately $17,000 to accomplish the work that is required at the <br />site. Thus we have a funding deficit of approximately $33,000.00. <br />We are requesting that the current Civil Penalty Grant be extended until December 31, 2009, in order that <br />we have time to secure additional sources of funding to make up the projected deficit. Further, experience <br />has shown that fall is the best time of year to work at the Fruita Mine in order that revegetation success <br />potential is maximized. Because we anticipate that the time factor and difficulty in obtaining additional <br />funds may be significant, we feel that it is necessary to plan for reclamation maintenance work to occur in <br />the fall of 2009.
