Cottony <br />Grand Junction, Colorado 81506 Division Director <br />Natural Resource Trustee <br />Re: Red Cliff Mine EIS and Permit Application Submittal <br />Dear Mr. Stover: <br />This letter is in response to our telephone conversation this morning regarding the timing <br />of the Red Cliff Mine permit application submittal to the Division of Reclamation, <br />Mining and Safety (Division). After giving careful consideration to issues concerning <br />the revised schedule for the EIS, we are recommending that CAM Colorado (GANG) <br />delay the application submittal until after the Draft EIS has been issued and until after <br />any plan modifications based on the Draft EIS have been incorporated into the <br />application. The Division's main concern is that an earlier submittal may include plans <br />subject to change, given the preliminary stage of the EIS process. This may cause <br />unnecessary delays in our permit review. <br />We understand that CAMC is concerned about the permitting process proceeding <br />sequentially and we understand CAMC's desire to proceed as efficiently as possible. We <br />are willing to do as much "concurrent permitting" as practicable while avoiding <br />potentially duplicative reviews. Therefore, the Division respectfully requests that <br />submittal of the application be delayed until the Draft EIS (incorporating agency <br />comments) has been issued and CAMC has incorporated the findings of the Draft EIS <br />into the application. . <br />If you have any questions or need additional information please call me. <br />Sincerely, <br />Michael P.
