Re: As-Built Certification for Sedimentation Pond 001
Design plans for sedimentation pond number 001, compiled ' gore 5 of the New Elk
Mining Permit, certified by Charles McGlothlin, dated 2/1512 have been reviewed by
Ronald Thompson, a Mine Engineer experienced in sediment control design and
construction and a MSHA certified impoundment inspector, and Charles M~Glothlin, a
Registered Professional Engineer in the State of Colorado. Mr. Thompson monitored all
phases of construction on a regulaz basis under the direction of Mr.1VI~Glothlin..
This inspection was conducted as required by Section 4.05.6 of the Regulations of the
Colorado Mined Land Reclamation Boazd for Coal Mining. As-Built construction details
are shown on Survey drawing dated 7/13/2007 as certified by Gary Terry PLS No. 12160
and are hereby incorporated into this Engineering Certification.
During construction the Emergency Spillway was moved eastward approximately 200
feet to lie in the center of the north face of the pond. This does not materially affect the
operation of the pond.
I HEREBY CERTIFY THAT POND 001 WAS CONSTRUCTED IN ACCORDANCE
WITH THE ABOVE REFERENCED DESIGN PLANS. FIELD MODIFICATIONS, AS
MAY BE NOTED ABOVE HAVE NOT ADVERSELY IlVIPACTED CRITICAL
DESIGN CRITERIA FOR POND VOLUME, AND EMBANKMENT AND
EMERGENCY SPILLWAY DIlvIENSION. PRIMARY SPILLWAY CONSTRUCTION
CONFORMS TO THE ORIGINAL PLAN DIlVIENSIONS DESIGNED AND
CERTIFIED BY CHARLES McGLOTHLIN, REGISTERED PROFESSIONAL
