rage 1 of ~
greg@lewicki.biz
From: "Mezei, Nick SPK" <Nick.Mezei@spk01.usace.army.mil>
To: <lewicki7@comcast.net>
Sent: Tuesday, September 13, 2005 4:50 PM
Subject: Olathe bank visit
Ben:
Visited the site with Mike, the delineation looks good. However we were both surprised to see that although most
of the knapweed was sprayed, they were still producing seeds -maybe sprayed late??. Also, there was some
knapweed that was not sprayed at all. Mike will be in touch with you about it.
I do not know if you still want to do the public notice at this time or wait until the weed is under better control. Let
me know after you talk it over with Mike and others, then let me know. The one issue I see is that even if you
start the process, the agencies might be reluctant to get into it until the weed issue is more resolved -but maybe
not. I had in mind processing the bank under a nw-27. The nationwides expire in March 2007, but if investments
have been made, nationwides can be extended one year beyond that. When reissued, I do not know but suspect
there may be additional restrictions on nw-27, though I do not foresee that using it to do mitigation banks would
be removed.
Think about it and let me know. Right now everything is on hold for two things : 1) the formal wetland verification,
and 2) info needed for the public notice.
Nick
Nick Mezei
Corps of Engineers
970.243.1199 x-1?
9/21 /2006
