Cattany To: Parties to the Pheasant Run Gravel Pit New 112(c) Application Division Director Natural Resource Trustee Re: Pre-hearing Conference Cancellation and Follow-up for the Pheasant Run Gravel Pit, New 112c Permit, No. M-2007-069 Dear Party: The Colorado Division of Reclamation, Mining and Safety (Division) received a timely, written objection to the application for the 112c permit for the Pheasant Run Gravel Pit, as named above. Therefore, in accordance with Rule 2.7.1 of the Construction Materials Rules and Regulations of the Colorado Mined Land Reclamation Board, aPre-hearing Conference was scheduled for January 29, 2008. However, on January 28th, 2008 the Division received a written request from the party to withdraw their previous objection to the application. As a result of the High Line Canal Company's formal withdrawal from party status, staff has withdrawn the matter from the Formal Public Hearing agenda before the Colorado Mined Land Reclamation Board. This development also nullifies the Division's requirement to hold the Pre-hearing Conference on January 29, 2008. The High Line Canal Company's completed Party Status Withdrawal Form is enclosed for your records.
