Exhibit F -Compliance with Appropriate Agencies <br />I <br />2 <br />3 <br />4 <br />5 <br />MLRB/DBMS - This operation has an existing Reclamation Permit issued by the <br />Colorado Mined Land Reclamation Board and the operation is in full compliance with <br />that permit. The permit is being amended to include these new lands. Although mistakes <br />can and do occur, periodic inspection by the Division of Reclamation, Mining and Safety <br />insures that mining operations are kept in close compliance with the permit. When <br />difficulties are found the mine operator is required to take corrective action in accordance <br />with a time requirement. If serious problems occur, the operator can be cited with a <br />violation, can be fined and can be ordered to close the operation until corrective action is <br />taken. In the most serious conditions or as a result of repeated non-compliance the permit <br />can be revoked, the financial warranty taken and the site reclaimed in accordance with the <br />permitted plan. In the event the financial warranty is insufficient, the State has a <br />performance warranty as well that allows the State to gain access to the assets of the <br />company to pay the remaining cost and if there are no assets then the State can bring suit <br />against the company officers, even if the company is bankrupt, to gain access to personal <br />assets to fund the completion of the reclamation. In the past, the State has had to proceed <br />with all of these options on some mining operations and the courts have upheld the rights <br />of the State to complete the reclamation using these approaches. In short, the reclamation <br />law has plenty of capability to insure that no mined land in Colorado goes unreclaimed. <br />Fugitive Dust - A copy of the fugitive dust permit is included in Appendix C. <br />Equipment emissions - Copies of the emissions permits are included in Appendix C. <br />Stormwater - A copy of the stormwater permit is included in Appendix C. <br />Water Rights - Water rights to meet the needs of the operation are held by Rick Hunt <br />and have been approved by the Colorado Division of Water Resources through a <br />substitute supply plan as well as the water court.
