III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.Bill Bear represented the <br /> operator,Bowie Resources LLC,during the inspection. The entire area was covered in snow due to a heavy <br /> snowfall last week.Most places had about one to two feet of snow cover at the higher elevations. <br /> Main Mine Site <br /> The paved haul road had been graded clear of snow and was dry and in good condition. The mine ID sign was <br /> up at the entrance. There was only a small volume of coal stockpiled at the lower coal stockpile bench. There <br /> were no problems with fugitive dust from the coal stockpile or from coal fines being tracked onto the highway. <br /> Across the highway,pond B had a little snow and ice covered water in it. On the D seam portal bench, a <br /> relatively small volume of coal was stockpiled.No problems with any of the facilities were observed. <br /> Coal Waste(Gob) Stockpile Area <br /> The haul road leading to the gob piles had been graded clear of snow and was passable. The haul road berm was <br /> in place.Most of the gob pile was covered in snow. The gob pile outslopes appeared to be stable,with no <br /> evidence of slumping. The operator was working on one area of the gob pile. Gob was being placed in the area <br /> while an excavator operator was removing soil material from the slope above to make room for additional coal <br /> waste. <br /> Just west of the gob pile and adjacent to the north side of the gob pile haul road,the snow and ice covered water <br /> level in pond C was above the primary. Across the road,pond D had a little snow and ice in it.During the <br /> inspection,the operator opened the pond C discharge valve as well as the valve that feeds pond C discharge <br /> water into pond D. Since the pond C discharge water was nearly clear,the operator switched the valve so that <br /> the discharge water would bypass pond D and be directly discharged offsite. Samples were taken by the operator <br /> for the Colorado discharge monitoring reports. Pond F,at the base of the gob pile,had only a little ice and snow <br /> covered water in it. <br /> Unit Train Loadout <br /> A unit train with empty railcars was on site but was not being loaded at the time of the inspection. There were <br /> no indications of any fugitive dust.Pond J and pond K were covered in snow. The loadout bench appeared to be <br /> stable.
