III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the Terror <br /> Creek Company during the field inspection.The area received a heavy snowfall the week before and the snow <br /> cover on the ground was at least one foot deep. <br /> Roads <br /> The paved main haul road was in good condition.No coal dust was seen on the highway at the loadout entrance. <br /> The graveled east side entrance road had some snow on it but was passable. The light use road along the tracks <br /> was also snow packed but passable. <br /> Facilities <br /> There was only a small volume of coal that was stockpiled on the facilities bench.During the inspection,the <br /> operator was using a front end loader to dump stockpiled coal into the coal grizzly. Railcars were being loaded <br /> as well.There was no evidence of fugitive dust during these operations. <br /> There were no problems at the loadout office, substation,weigh station or coal handling facilities. <br /> Hydrology <br /> The east side sediment pond was completely covered in snow.The snow level was at least three feet below the <br /> elevation of the primary discharge tube. The gated valve on the primary tube was in the closed position. The <br /> west side dugout sediment pond was also covered in snow. <br /> All of the ditches and culverts,as well as the silt fence and straw bales along the railroad track small area <br /> exemption, were covered in snow. <br /> Signs and Markers <br /> The mine ID signs were up at the main entrance,east side entrance and along the east road next to the railroad <br /> tracks. The required information was on each of the'signs. <br /> Topsoil Stockpiles <br /> The east topsoil stockpile and the west topsoil stockpile were completely covered in snow. Topsoil signs were <br /> up on both of the stockpiles. <br /> c:/word/terror/insp0108 <br />
