III. COMMENTS-COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator
during the field inspection. The entire area received considerable snowfall the week before and there was one to
two feet of snow at the mine site.
Roads
The entrance to the mine site was blocked by a snow berm that was made from the grading of the main highway.
The paved haul road into the site was snow covered,as was the bridge.
Signs and Markers
The mine ID sign was on the ground and buried under snow at the top of the hill. The sign needs to be put back
up. The"no trespassing" sign was on the front gate.
Facilities
The front gate at the bottom of the hill was closed but not latched or locked. The mine office debris has been
burned in place. However, there is still some of the office material that needs to be disposed of properly.
Hydrology
The sediment pond was covered in snow but the snow level was at least two feet below the level of the primary
discharge pipe. The hillside spring water treatment pond was also covered in snow. The treatment pond was
discharging. The hillside spring was flowing into its constructed channel that, eventually, flows-into the
treatment pond.
The riverside protection berm was snow covered but appeared to be functional.
c:/word/bear3/insp0108
