(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1999-120 <br />INSPECTION DATE 01/03/08 <br />OB3HRVATION3 <br />INSPECTOR'S INITIALS ESC <br />This was an acreage release (AR-O1) inspection of the Fort Lupton Sand and Gravel Mine <br />conducted by Erica Crosby and Peter Hays of the Colorado Division of Reclamation, Mining and <br />Safety. Lynn Mayer Shults of L.G. Everist, Inc. was present during the inspection. The site <br />is located 2 miles northwest of Fort Lupton in Weld County, Colorado. The Division holds a <br />reclamation bond in the amount of $526,000.00 <br />The Division received the AR-O1 release request on November 7, 2007. The operator is <br />requesting the release of 5.192 acres of permitted acres. The 5-acre area is located in the <br />northeast corner of the Swingle North Pit. This area is within the permit area but was never <br />mined due to the house and outbuildings located on site. Fred Dodge, the landowner of the 5- <br />acre parcel, was present during an inspection of the site. Snow cover was present, but it <br />was apparent that no mining or any mining related disturbance has taken place. L.G. Everist <br />will need to submit updated maps (Mine Plan and Reclamation Plan Maps) reflecting the removal <br />of the 5-acre parcel from the permit area. Revised maps will need to be submitted by March <br />3, 2008. Failure to do so will result in the Division denying the AR-O1 application. <br />The Division inspected the active areas of the Fort Lupton Site. Mining is currently taking <br />place in the Hill Oakley property. Mining started in this area in 2007 and will last for <br />approximately 5-6 years. A slurry wall barrier has been constructed around the perimeter of <br />the site to prevent groundwater from entering the pit. The slurry wall has been approved by <br />the Office of the State Engineer and was previously submitted to the Division. In some places <br />the pit is 50 feet in depth and in other areas it ranges from 20 to 25 feet. The operator <br />stated that the topsoil salvage depth ranges from 6" to 18". The operator is also mining in <br />the Golden Pit. Slopes of the Golden Pit have recently been regarded to approximately 3h:ly. <br />Concrete piles were noted on site that have been imported into the permit area. L.G. Everist <br />stated that the concrete is recycled on site and sold as a product, use'd'as material to make <br />French Drains and/or used to stabilize pit slopes. In accordance with-Rule 3.1.5(9) of the <br />Construction Materials Rules and Regulations, if an operator intends 'to backfill material <br />generated from outside of thd'~~pproved permit area the operator must notify the Division in <br />writing. Attached is a copy of the rule that defines what must be included in the notice. <br />The operator will need to provide the noti~~to the Division on or before March 3, 2008. See <br />page 3 for further detail. <br />It was noted during the inspection that topsoil piles may be in difent locations than <br />noted on the approved Mine Plan Map.
