(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2005-050 <br />INSPECTION DATE: 1-3-08 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS GRM <br />This inspection was conducted as part of the normal monitoring program established by the Colorado Division of <br />Reclamation, Mining and Safety for permitted sites. The J-Birds permit was recently transferred by Succession of <br />Operator (SO) from Rimrock Exploration to Blue Rock Energy. The SO along with a notice of beginning of <br />operation triggered the need for this inspection. <br />The J-Birds Mine permit was approved in 2006 by the Division while BLM was still in its review process. Due to <br />regulatory constraints, the Division approved the permit with a stipulation that once BLM was finished with the <br />process the permit holder would submit the BLM permit for Division review. Any discrepancies would be <br />addressed through a Technical Revision or amendment to ensure that the DRMS regulations and permit were <br />properly addressed. Those issues are currently being addressed. In particular the stonmwater management and geo- <br />chemical testing of waste and ore rock are being reviewed. Per the approval letter, the operator was required to <br />provide written notice prior to initiating any disturbance. Blue Rock Energy did so on December 20, 2007. <br />The inspector inquired as to whether Blue Rock had addressed a few issues noted in the December 27, 2007 <br />correspondence with BLM. Blue Rock indicted that BLM had the information initially but missed it during its <br />review and that those issues were now resolved. <br />Current activities include the building of stormwater controls and development of the portal pad. The portal itself <br />should be under construction within the next few weeks. The total area of disturbance is approximately 2 acres at <br />this time. The inspector notes that clay soils are being used to construct the stormwater retention pond dam. <br />Equipment traffic is being used for compaction and appears to be doing a very good job. Walking on the dam <br />produces no foot prints or tracking even in wet conditions. Diversion ditches are being constructed into the pond <br />area and topsoil is being used for berms. Blue Rock will need to seed any topsoil berms or stockpiles if they will <br />remain in place for more than 1 growing season. The inspector notes silt fencing and hay bales in place for <br />sedimentation and erosion control while other more permanent measures are being constructed. <br />The portal pad area is being cleared of juniper and pinion trees. Trees slash is being placed in piles and some wood <br />is being salvaged for possible firewood. Blue Rock has indicted it has received a wood cutting permit from BLM as <br />part of their overall approval process. <br />The mine identification sign and affected area boundary markers were not observed and must be installed per the <br />requirements of Rule 3.1.12 that state: <br />1) The operator shall post a sign at the entrance to the mine site which shall be clearly visible from the access road <br />and specify the following: <br />a) The name of the operator; <br />b) indicate that a reclamation permit for the operation has been issued by the Colorado Mined Land <br />Reclamation Board; <br />c) the permit number. <br />2) The boundaries of the affected area will be marked by monuments or other markers that are clearly visible and <br />adequate to delineate such boundaries. <br />Based on the fact that the operation is just starting this is being noted as an issue of concern instead of a problem. <br />This means that it is being noted for future review and maybe changed to a problem or possible violation if not <br />corrected by the next inspection. It should be noted that the operator discussed where the sign should be located and <br />what was needed for permit boundary markers.
