Within the permit boundary, Colowyo is the holder of Federal Coal Lease No. D-034365,
"C"35874, C-29224, C-29225, C-29226 and State of Colorado Coal Lease 257-13S.
The surface and mineral ownership in the permit and adjacent areas is graphically shown on
the Surface Ownership Map (Map 1) and the Coal Ownership Map (Map 2) and the
information found in Exhibit 1, Documents and Leases.
Colowyo is the only holder of record of any leasehold interest in the property to be mined or
to be affected by surface operations and facilities incidental thereto. There are no other
holders of record of any leasehold interests for areas located within the property boundary.
Colowyo is both the applicant for the permit and the operator of the mine. The resident agent

Colowyo is a limited partnership duly authorized to do business in the State of Colorado.
Effective December 6, 1994, Kennecott Colorado Coal Company, a Delaware corporation,
became the sole general partner of Colowyo Coal Company L.P. Gracoal, Inc., a Delaware
corporation and Gracoal II, Inc., a Delaware corporation, are the limited partners. (Gracoal,
Inc. and Gracoal II, Inc. are identified here for informational purposes only and are not
"owners or controllers" of Colowyo.)
There is no pending purchaser of record of any surface or mineral estate under a real estate
contract for areas located within the permit boundary.
