Dear Mr. Filas:
The Division of Reclamation, Mining, and Safety (DBMS) is in receipt of your responses to the preliminary
adequacy review, and, has determined that the responses constitute a technical revision to the application.
From a telephone discussion with Greg Lewicki this afternoon, DBMS understands that the responses will
be placed for view at the Mesa County Clerk and Recorder's Office tomorrow, January 18, 2008.
Therefore, and in accordance with rule 1.8.4 of the Hard Rock/Metal Mining Rules of the Colorado Mined
Land Reclamation Board, the date for consideration. of the Whirlwind Mine application is hereby
established as February 8, 2008. The pre-hearing conference that had been scheduled for January 29, 2008
will be rescheduled.
