<br />2.03.6 Right of Entry and Operation Information
<br />(1) Detailed legal description of the permit boundary, description of the documents upon which
<br />the transferee bases its legal right to enter and begin coal mining operations and whether that
<br />right is the subject of pending litigation:
<br />Permit Boundary -Legal Description
<br />The surface facilities for the Elk Creek Mine, Sanborn Creek Mine, and the former Somerset
<br />Mine are located north of the town of Somerset, which is nine miles northeast of Paonia,
<br />Colorado. All are north of the North Fork of the Gunnison River (located due south of the
<br />town of Somerset) and north of State Highway 133 and the Union Pacific Railroad rights-of-
<br />way. The Elk Creek Mine is located approximately one mile north and the Sanborn Creek
<br />Mine is located approximately one mile east of the town of Somerset.
<br />The Elk Creek Mine and Sanborn Creek Mine permit area is located on the following
<br />described lands:
