(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-223 <br />INSPECTION DATE 10/25/2007 INSPECTOR'S INITIALS DEZ <br />OBSERVATIONS <br />This inspection of Permit Number M-1977-223 (Wiley Pit) was conducted by Deb E. Zack of the DRMS due to an approved <br />succession of operator's application. Mike Jacobson, Five Rivers Ranch Cattle Feeding LLC representative, was unavailable at <br />the time of this inspection. The pit is located approximately 1 mile north of Lamar, CO and currently consists of approximately <br />87 acres, of which approximately 18.25 acres appear to be at various levels of disturbance. <br />The mine entrance identification sign and permit boundary markers must be clearly posted per Rule 3.1.12(1)(c) and Rule <br />3.1.12(2) (see Problem No. 1 on pg. 3). The topsoil stockpile runs along the western extent of the permit boundary (see photo <br />1). This inspector collected the following information using the Division's Trimble GPS unit: <br />• The dimensions of the topsoil stockpile were calculated to be approximately 20'(h) by 30' (w) by 960' (I) making the <br />total approximate cubic yardage 21,333 cuyds. <br />• The pit area is approximately 2,115 linear feet, and is high walled. <br />• The total acreage of the disturbed area is approximately 18.25 acres. <br />The majority of the site to the north and east appears to have not been disturbed at all at the time of this inspection. However, <br />over the center of the western portion of the site (where the pit lies) substantial amounts of earthmoving would be necessary in <br />order to bring down the high wall that exists, and to reapply topsoil across the area. These two criteria, as well as components <br />of revegetation such as seeding, mulching and fertilization, are the main factors of the bond calculation that is forthcoming. This <br />bond calculation and any corresponding requirements will be sent to the current operator under separate cover in the near <br />future. <br />Finally, Tamarisk were observed during this inspection, mainly on the pit floor (see photos 1, 3 and 4). The Operator is advised <br />to treat the Tamarisk, while the infestation is relatively small and localized, with an approved herbicide, or excavate and dispose <br />of the Tamarisk while the site is being worked. If the Operator chooses to address the Tamarisk problem while the site is being <br />worked, the Division will require a letter committing the Operator to this course of action. If the Operator decides to spray or <br />otherwise treat the Tamarisk with chemicals, then a weed control and management plan must be created per Rule 3.1.10(6) on <br />or before April 30, 2008 (see Problem No. 2 on pg. 3). This plan should be developed in consultation with the county extension <br />agency, or weed control district office, and should include specific control measures to be applied, a schedule of when the <br />control measures will be applied, and apost-spray monitoring plan. The operator is advised that this site will not be <br />released if Tamarisk is found on site, and must, therefore, be removed or treated adequately prior to pnancial warranty <br />release. See the enclosed Division-approved recommendations for Tamarisk control. <br />All other activities and completed work at the time of inspection appeared to follow the guidelines and regulations set forth by <br />the state and in the mining and reclamation plans for the pit. At the time of this inspection there appeared to be no long-term <br />(greater than 72 hours) water retention. The site is stable and no disturbance was observed outside of the approved permit <br />boundaries. <br />Responses to this inspection report should be directed to Deb E.
