The total area of pond surface exposed after December 31, 1980 for each of <br />the unlined pits shall not exceed those values listed in Table A of this <br />approval. Should the total surface area exposed exceed those amounts, an <br />amendment will need to be filed with this office. The total lagged depletions <br />resulting from operation of the pits shall not exceed those amounts specified <br />in attached Table 3. Should the lagged depletion from any of the pits exceed <br />the values listed in Table 3, an amendment will need to be filed with this <br />office. <br />3. All pumping for dust control shall be measured in a manner acceptable to the <br />division engineer. <br />4. The Applicant shall not claim credit for the 25 Fulton Ditch shares referenced <br />in this SWSP unless use of such shares is approved by the Water <br />Commissioner. <br />5. The Water Commissioner responsible for the administration of this plan is Mr. Robert <br />Stahl, 9378 WCR 25, Fort Lupton, CO 80621, phone no. (303) 857-0742. The <br />applicant shall maintain daily records of all diversions, replacements, and the amount <br />of water used for each particular purpose. The applicant shall provide a report of <br />these records to the division engineer and the water commissioners on a monthly <br />basis on a form approved by them. The accounting must be submitted within thirty <br />(30) calendar days of the end of the month for which the accounting is being made. <br />Failure of the Applicant to provide timely accounting to the water commissioners may <br />result in revocation of this SWSP. <br />In addition, the applicant shall submit a report from each entity making <br />replacements; for this plan, that entity is the City of Aurora. The report shall <br />include an accounting of all wastewater plant water effluent controlled by <br />each entity, showing the total volume of water under its control at the various <br />wastewater treatment plants, and the amount committed to each of the <br />recipients of the water. <br />6. All releases of replacement water must be sufficient to cover all out of priority <br />depletions and be made under the direction and/or approval of the Water <br />Commissioner(s). The replacement may be aggregated to maximize <br />beneficial use. The Water Commissioner(s) and/or Division Engineer shall <br />determine the rate and timing of an aggregated release. <br />7. The replacement water, which is the subject of this plan cannot be sold or <br />leased to any other entity. As a condition of subsequent renewals of this <br />substitute water supply plan, the replacement water must be appurtenant to <br />this site until a plan for augmentation is obtained. A copy of this approval <br />letter should be recorded with the county clerk and recorder. All replacement <br />water must be concurrent with depletions in quantity, timing, and locations. <br />The use of replacement water must be in compliance with all agreements with <br />the providers of replacement water. <br />
