Box <br />203 Eureka Street <br />Centiral City, CO 80427 <br />1tE: Proposed MMRR Aggregate Quarry / Gilpin County /Pending Application M2004067 <br />Dear Mr. Peterson, <br />The Upper Clear Creek Watershed Association (UCCWA) is the designated 208-management agency <br />responsible for testing, monitoring, overseeing, and reporting water quality and water resources issues <br />through the upper portion of the Clear Creek Watershed. Our membership includes 20 municipalities, <br />counties, and dischargers located in the upper Clear Creek watershed in Clear Creek and Gilpin Counties. <br />As such, we have a responsibility to review the potential impacts to water quality from the proposed <br />MMItR mining operation. <br />At our meeting on January 10, 2008, after hearing a presertation on the MMRR Quarry application from <br />Alex Schazt of Banks and Gesso, LLC, the membership of UCCWA voted 8 to 0 with 2 abstentions to <br />submit this letter of opposition to the MMRR Quarry proposal, Members have reviewed relevant parts of <br />the 629 page application and our opposition and concerns are as follows: <br />I. Dust Control - We are concerned that the dust control plan as described in the proposal will be <br />insufficient to prevent dust, sift, and sediment from leaving the quarry and eventually being <br />transported into the North Fork Clear Creek. <br />2. Dust Control - A vacuum sweeping truck should be employed to control and coIiect dust, silt, <br />and sedimer to preclude transport from the quarry site. <br />3. Dust Coutro! -Afire cleanup station should be required along with alI necessary procedures for <br />cleanup of truck tires prior to truck entry onto Highway l 19. Any materials transported onto to <br />the Highway are likely to eventually make their way irrto the North Fork Clear Creek. <br />4. Water ControUDiversion structure, construction, operation and maintenance -While the <br />Best Managemem Practices (BMPs) describe in Appendix E sound good, we are concerned that if <br />there are no requirements for maintenance of these BMPs, then their effectiveness will be quickly <br />compromised. We are concerned that sediment and silt may still reach North Fork Clear Creek. <br />MMRR should submft their Stormwater Management Plan for our review and for the review of <br />Gilpin County. The Stormwater Management Plan should include information about inspections <br />
