SCC has applied for a Phase I <br />Reclamation bond release on a portion of the mined and reclaimed area. As part of the future final reclamation <br />plan, SCC will leave a portion of the road (Road B) that crosses federal property for permanent access from <br />County Road 27 and 37 to SCC's mining and reclamation area (including federal property) and the miscellaneous <br />fences inplace on federal property that establish property boundaries and/or grazing control. These features aze in <br />conformance with the approved postmine land use plan. <br />We propose that the road be left (approximately 20 feet wide) with the centerline remaining in approximately the <br />same location as currently exists. The attached figure shows the portion of the road on federal land and the other <br />property owners in relation to the location of the road including the light use road LU3 that provides access to an <br />existing 2-track across undisturbed acreage that SCC currently uses for access to monitoring wells. These roads <br />will replace the roads that existed prior to mining. <br />SCC will apply for release of the bond held by the Colorado Division of Reclamation, Mining and Safety. The first <br />step is to obtain a letter from the landowner requesting that the feature/structure be left as permanent. This step <br />is in accordance with the Colorado Mined Land Board Regulations for Coal Mining. <br />• Rule 2.05.5(1, thepostmining land use description shall be aanmpanied by a copy of the comments concerning theproposed <br />use by the legal or equitable owner of record of the surface of the proposed permit area and the State and localgovernment agencies <br />which mould have to initiate, implement, approve, or authorize the proposed use of the land following rzclamation. <br />• Rule 4.03.1(11(fl. all haul reads .shall be rrmoved and the land affected reclaimed in accordance with the requirements of <br />4.03.1(7) unlesr.• <br />(i) Retention of the road rs approved as part of the approved postmining land use and the road complies with al! applicable <br />performance standard.;; and <br />(ii) The landowner requests to the Division in writing, that the road or certain parts thereof ors to be left open for further use. <br />If you have any questions, please contact Roy Kano at (970) 276-5217 or 846-3648, otherwise we request that you <br />sign one copy of the attached request letter and return it to Seneca Coal Company in the self addressed stamped <br />envelope.
