CDRMS <br />will be notified of any major movement detected and a remediation plan will be <br />prepared based on the severity of the situation. If no (or negligible) <br />movement is detected after four quarters, the information will be submitted to <br />CDRMS along with a request to suspend the monitoring. <br />CONSTRUCTION SUMMARY <br />The impoundment, embankment, principal spillway and emergency spillway were <br />constructed in 1992. The original design, as-built plans were prepared under <br />the supervision of others. Pond 005 was originally constructed as shown on <br />Exhibit 13-5A pond 005 As-Built, which was certified by Ronald J. Gehrke, a <br />registered professional engineer in the State of Colorado (P.E. #19959) <br />experienced in the design and construction of earthen structures. <br />The construction was supervised on site by Mr. Chuck McCulloh, Operations <br />Engineering Manager at the Seneca II-W Mine (circa 1992). Mr. Thomas <br />Wainwright, P.E., Senior Engineer was at the site on June 22-26, 1992. Mr. <br />Gehrke inspected the structure on July 13, 1992 to verify the pond's principal <br />spillway installation and embankment construction. Mr. Gehrke verified the <br />as-built conditions during a site inspection on August 5, 1992. <br />The purpose of the inspections and certification were to ensure proper <br />construction of Pond 005 and to satisfy the requirements of Rule 4.05.6(7) of <br />the Regulations of the Colorado Mined Land Reclamation Board. The material <br />was placed in the embankment to meet or exceed the design specifications (see <br />Addendum 13-5-E for compaction information). <br />CERTIFICATION STATEMENT <br />To the best of my knowledge, based upon my professional expertise, and to the <br />extent possible, Pond 005 was constructed in accordance with the prudent <br />state-of-the-art of earthen embankment construction. Further, the structure <br />was constructed in compliance with the approved design, to the extent <br />possible, as specified in Attachment 13-3 of the approved II-W Mine permit <br />application package. Minor field adjustments in horizontal and vertical <br />alignment were necessary during construction to compensate for unanticipated <br />natural conditions, to limit the disturbed area, and construct a structure <br />consistent with the existing topography. <br />It is in my opinion, based on the as-built assumptions presented in this <br />Attachment and Exhibit 13-5A, that Pond 005 will meet the requirements of <br />Rules 4.05.6(3)(a), 4.05.9(2)(b) and 4.05.9(2)(c)(iii). <br />• <br />TR-59 13-3C-8 Revised 05/07 <br />
