(14) Alt mined material to be disposed of within the affected area must be handled in <br />such a manner so as to prevent any unauthorized release of pollutants to the surface <br />drainage system: All mined material-will be handled in such a manner so as to <br />prevent any unauthorized release of pollutants to the surface drainage system. All <br />stockpiled material will be located and managed so as to avoid any uncontrolled runoff. <br />All stromwater runoff from the site will be in accordance with its Stormwater <br />Management Plan. A Stormwater Permit is only required where an operation has the <br />possibility of a discharge to state waters from stromwater that can come into contact with <br />any overburden, raw materials, intermediate products, finished products, by products or <br />waste products located at the site of such operations. The Operator intends to operate the <br />site such that stormwater will either be prevented from contacting the above listed items; <br />or where it does come into contact with any of the above listed items, it will not be <br />discharged from the site. Regardless, a Stormwater Discharge Permit will be obtained. <br />In addition, the Stromwater Management Plan will be in place for the operation. <br />(11) No unauthorized release of pollutants to ground water shall occur from any <br />materials mined, handled or disposed of within the permit area: No ground <br />water pollutants shall be released from the site. Concrete and/or asphalt batch plants and <br />possibly fuel storage sufficient for on-site operations may be necessary. It is unlikely, <br />however, that a spill will reach surface or ground water since such activities will occur <br />within the area surrounded by the slurry wall and will therefore be contained within the <br />facility. In any event, the operator will have a Spill Prevention and Containment and <br />Countermeasure (SPCC) Plan in-place to handle spilled fuel within the permit boundary. <br />3.1.6 Water-General Requirements: <br />(1) Hydrology and Water Quality: Ground water is discussed in Exhibit "G" -Ground <br />Water Information. As proposed, the mining and reclamation plans will not adversely <br />affect surface water hydrology or surface and ground water quality. <br />As discussed, the Operator will implement its Stormwater Management Plan and will <br />obtain a Stormwater Discharge Permit. <br />(a) Compliance with applicable Colorado water laws and regulations governing <br />injury to water rights: Operator will comply with Colorado water laws and <br />regulations governing injury to existing water rights. <br />(b) Compliance with applicable federal and Colorado water quality laws and <br />regulations, including statewide water quality standards and site-specific <br />classifications and standards adopted by the Water Quality Control Commission: <br />The Operator will comply with applicable Federal and Colorado water quality laws and <br />regulations, including all the standards adopted by the State Water Quality Control <br />Commission.
