III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Comments <br /> This was an aerial inspection of McClane Canyon Mine. The flight was on 12/13/07. Harry Ranney of DRMS <br /> recorded 6 near vertical digital images, covering the mine facilities from the portal area down to the office <br /> location. There was a solid cover of fresh snow in all non-travelled areas, and it appeared to be snowing at the <br /> time of the flight. These conditions made detailed observations difficult. <br /> Although details were difficult to discern, it did appear that disturbances were properly contained within approved <br /> disturbed area boundaries and sediment control systems, and no problems were evident. <br /> Minor Revision No. 44, allowing expansion of the sediment cleanout/coal waste temporary storage area near the <br /> sediment pond has been approved and required bond was submitted to the Division on December 18, 2007. As <br /> such, the operator is now authorized to initiate the project. The project work had not yet been initiated when the <br /> flight was made on December 13. <br /> 3 <br />
