Ill. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 19 December 2007 <br /> Pg 1/6 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br /> CDRMS. The inspection was conducted on 19 and 20 December 2007, Tony <br /> Tennyson of CCC accompanied me on the inspection on 19 December 2007 and <br /> Kurtis Blunt accompanied me on the inspection on 20 December 2007. Tay Tonozzi <br /> and I briefly discussed some of the permitting actions that are currently outstanding <br /> at the Colowyo Mine and ones that are in the planning stages. The mine was <br /> actively mining coal and hauling coal to the loadout at the time of the inspection. <br /> The weather was very cold, windy and it was snowing, with heavier snows at the <br /> higher elevations of the mine. The ground was a frozen and covered with anywhere <br /> from a few inches to more than a foot of snow. <br /> Availability of Records: The records were checked on the afternoon of 19 December <br /> 2007. All of the necessary records were in order and available for review at the mine <br /> office. Please see the DBMS Availability of Records form at the end of this inspection <br /> report for more detailed information. <br /> Signs and Markers: - All of the necessary signs were in place as required at the time <br /> of the inspection. Mine ID signs were in place at the main entrance and at all of the <br /> ponds along Colorado Highway 13 as required. Colowyo has a mine identification <br /> sign at the access point (by the Sturgeon house) along Colorado Highway 13. <br /> Roads: - The mine access road and haul road to the Gossard Loadout is a paved <br /> road. The road was wet at the time of the inspection but it was well maintained <br /> and in good condition. <br /> - The light-use road in Taylor Draw to the West Pit Pond, East Taylor Pond and West <br /> Taylor Pond was covered with snow but it appeared to stable and well maintained at <br /> the time of the inspection. There were some minor ruts but overall the road was in <br /> good condition. <br /> - The haul roads in the East and West pit areas were wet but well maintained and <br /> stable at the time of the inspection. No erosional problems were noted on these <br /> roads. <br /> - The light-use roads around the Gossard Loadout and to the rail loop were well <br /> maintained and in good condition. <br /> - The haul roads in the Bower project area (topsoil removal) are well maintained and <br /> appear to be stable. These roads are in the Taylor Draw and along the west edge of <br /> the Section 16 Pit. There is also a new haul road that was constructed just south of <br /> the existing Section 16 Pit. This road is for continued topsoil removal operations in <br /> advance of the mining in the South Taylor area. This road was wet and covered with <br /> snow in areas. The operator was actively working on the road .condition. <br />
