(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1989-009 <br />INSPECTION DATE 10/24/2007 <br />INSPECTOR'S INITIALS DEZ <br />This routine monitoring inspection of Permit Number M-1983-132 (DeWitt Excavating) was conducted by Deb E. Zack of the <br />DRMS. Company representative Rudy Torres was available for this inspection. The pit is located''/z mile south and Y. mile west <br />of Lamar, CO, and currently consists of approximately 8 acres where approximately 4 acres are currently disturbed. <br />Mine entrance signs and permit boundary markers are all in place. This site consists of a blown sand dune, and there is a <br />distinct lack of topsoil both on the permit area, as well as all of the native surrounding area. <br />It appears that the majority of the site's sand has been mined down to a level where an acceptable growth medium for <br />vegetation exists. Grading appears to have been done properly on this site. In addition, an adequate amount of volunteer <br />vegetation has established on at least half (4 acres) of the 8-acre site. <br />The onlyoutstanding issue that requires resolution prior to an acreage release request (as was inquired about bythe operator <br />during this inspection) is for the Division to receive formal documentation from the operator in the form of evidence <br />(photos) of the removal of all trash and debris observed on site. <br />Based on the trndings of this inspection, a 4-acre portion of site is designated as ready for release, and will be <br />released if a formal release request is received within 60 days of receipt of this inspection report, as well as formal <br />evidence (in the form ofphotos) confirming that the debris has been removed from the site. <br />The operator can request the 4-acre acreage release after the 60-day mark from receipt of this inspection report, but that will <br />require an additional inspection of the site. In any case, removal of the debris from the site and photographic evidence of the <br />clean-up is required to be submitted to the Division on or before April 1, 2008. <br />Information requested by the operator regarding the actions required foran acreage release request (see enclosed example <br />acreage release request), as well as the procedures for an amendment to add adjacent acreage is enclosed along with this <br />inspection report. Please note that the acreage release request and Division approval process must conclude prior to the <br />amendment process to add acreage if the operator desires to keep this permit as a 110c operation (less than 10 acres permit <br />area). If the operator desires to increase acreage without releasing acreage (so that the total permit acreage is greater than <br />9.99 acres) then the operator must follow the procedures for a conversion of this permit to a 112c operation. See page 34 for <br />the amendment application requirements (section 1.10.1(2)). This Rule lays out the basic requirements foran amendment, as <br />well as the fact that for any Exhibits described on pages 127-138 (all of Rule 6.3) that will not change as a result of the <br />amendment are not required to be resubmitted. However, at some place in the application, the Division requires a note <br />describing which Exhibits have not changed. There is no fee foran acreage reduction, but the fee foran amendment fora 110c <br />operation is $827 payable to the DRMS. <br />All other activities and completed work at the time of inspection appeared to follow the guidelines and regulations set forth by <br />the state and the mining and reclamation plans for the pit, and no additional problems are noted for this site. At the time of this <br />inspection there appeared to be no long-term (greater than 72 hours) water retention. The site is stable and no disturbance was <br />observed outside of the approved permit boundaries. <br />Responses to this inspection report should be directed to Deb E.
