III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick and Dan Hernandez of the Colorado <br /> Division of, Reclamation, Mining, and Safety (Division) on 17 and18 December 2007. Records were <br /> checked at the Routt County Courthouse on 17 December 2007. The weather was clear and sunny <br /> on 12/18 during the on-the-ground inspection of the site. There was a substantial amount of snow <br /> cover throughout the mine site. <br /> Availability of Records <br /> All required records were on file with five comments noted (see attached checklist). John Weinman of <br /> Hydro-Environmental solutions, Inc. accompanied the records check. <br /> Signs and Markers <br /> The mine I.D. signs were in place at the entrance of the Old Tipple Road entering the mine area to the <br /> south and the North Road entering the mine area from the north. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge Road were covered with a substantial amount of snowfall. Portions of all of <br /> these roads were traversed on foot during the inspection, with the exception of the Old Tipple Road, <br /> and appeared to be stable. No problems were noted. All road culverts were covered with snowfall <br /> and therefore unable to be inspected. <br /> Hydrologic Balance <br /> All sediment ponds contained water with substantial ice and snow cover evident. All embankments <br /> appeared to be stable with no visible signs of erosion or damage. <br /> Moffat pond had a trickle of discharge occurring at the time of the inspection (photo 1). It appeared <br /> that there had been some monitoring of the discharge recently as evidenced by recent snowmobile <br /> tracks at the discharge point of the pond (photo 1). The four Moffat down drains were covered in snow <br /> but appeared stable with no evident signs of damage. <br /> The Center and West Ridge Ponds did not appear to be discharging at the time of the inspection. The <br /> Center Ridge Pond did have water within the discharge culvert but it was not clearly evident of <br /> discharge. There was water flowing in the drainage next to the Center Ridge Pond but it was unclear <br /> as to whether discharge from the pond was contributing to the collection in the diversion due to the <br /> high amount of snowfall. (Photos 2 and 3) <br /> The drainage from the Center Ridge Pond appeared to have a damaged metal crossing at the west <br /> end close to Trout Creek. This metal crossing should be addressed to repair or replace. (Photo 4) <br /> The "string-of-pearls" permanent drainage channel contained a substantial amount of snowfall. The <br /> Northern end (lowest point near the West Ridge Pond) appeared to be stable with no signs of <br /> damage. <br />
