III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal Mine was conducted by DRMS staff from the <br />Durango Office, 701 Camino del Rio, Room 315, Durango, CO 81301, phone (970) 247-5469. Four <br />photos accompany this report. <br />Mine identification sign was posted at the entrance to the permit area. Mine entrance gate was <br />locked. The site was dormant during the inspection, no mining or reclamation activities were <br />occurring.. Snow cover of approximately four inches existed throughout the permit area. <br />Fresh vehicle tracks were observed on reclaimed areas at the rock fill area and areas nearby Topsoil <br />Stockpile 7, as well as reclaimed lands for the adjoining Ewing Mesa Pit No. 1. Fresh vehicle tracks <br />were also observed bypassing the locked entrance gate to the north. <br />A Nissan Frontier XE-V6 pickup truck, bearing Colorado license plate number 015-NFU, appeared to <br />have been abandoned on the entrance/haul road within the permit area. As shown in the photos, the <br />abandoned vehicle had a'tow strap attached. to the front bumper. <br />A set of dual culverts had been removed from the East Collection Channel and the channel restored to <br />its approved configuration. The dual culverts, located immediately north of Topsoil Stockpile 7, were <br />associated with an obstruction in the East Collection Channel and a resulting escape of affected area <br />drainage from the sediment containment system. Failure to maintain the East Collection Channel had <br />resulted in violation CV-2007-005. With the removal of the obstruction to the East Collection Channel <br />and restoration of the channel to its approved configuration, the Operator satisfied the corrective <br />actions required by the violation. Violation CV-2007-005 was terminated on December 10, 2007. <br />During the time of this inspection evidence of affected area drainage escaping the sediment <br />containment system was not observed.. <br />
