<br />r-5 <br />Creek shaft site but Bowie did not stockpile this topsoil-like material within the permit <br />area. <br />A site visit to the City of Paonia Water Pollution Control Facility showed that the excess <br />rock and topsoil-like material had been stockpiled next to other soil material just outside <br />of the facility. About 250 cubic yards of topsoil-like material were stockpiled on the west <br />side of the pile and several times that volume of excess rock and associated dirt extending <br />behind the topsoil-like material to the east. Therefore, no material had actually been lost. <br />Since the excess rock had been transported to a storage site not approved by the Division <br />and because topsoil-like soil had not been stockpiled within the permit area, Notice of <br />Violation CV-2007-006 was issued. <br />There are two abatement steps for NOV CV-2007-006, one dealing with the topsoil-like <br />material and the other dealing with the excess rock. The first abatement step is to <br />transport the topsoil-like material from the Paonia Water Pollution Control Facility to the <br />Hubbard Creek vent shaft construction site for storage or to another topsoil storage area <br />approved by the Division through a minor revision. Field Minor Revision No. 84 was <br />approved so that the topsoil-like material from the Paonia facility or from the Hubbard <br />Creek vent shaft construction site can be stockpiled at the Bowie No. 2 unit train loadout <br />main topsoil stockpile. The due date for abatement of step one is 5 pm on November 23, <br />2007. I have not verified this in the field yet but should do so this week. <br />The second abatement step is to transport the excess rock to the Bowie No. 1 Mine as <br />approved in Minor Revision No. 83 or obtain Division approval through a technical <br />revision to keep the excess rock at the Paonia facility. The due date for abatement is 5 pm <br />on December 17, 2007. <br />Attached is the file folder for NOV CV-2007-006, which contains the NOV and the <br />corresponding field inspection report. Since the NOV was issued on November 16, 2007, <br />the last day for the operator to provide comments on the NOV was Monday, December 3, <br />2007. No comments were received from the operator. The proposed civil penalty <br />assessment is due on Monday, December 17, 2007. <br />If you need any additional information, please let me know.
