5. Section 34-32.5-124(6) of the Act states that the Board may suspend, modify or revoke a
permit if, following a hearing, the Board determines that a violation of a permit provision
has occurred. Section 24-4-106(4) of the Administrative Procedures Act authorizes
agencies conducting hearings to issue appropriate orders to control the subsequent course of
proceedings.
6. Based on the Division's recommendation, it is appropriate for the Board to modify its prior
Board order in this matter by extending the due date for all incomplete Board-ordered
corrective actions to May 16, 2007. The corrective action that remains to be completed is
for the Operator to convert its existing Section 110 reclamation permit into a Section 112
reclamation permit.
ORDER
Based on the foregoing findings of fact and conclusions of law, the Board hereby modifies its
prior Board order in this matter to require the Operator to convert its existing Section 110
reclamation permit into a Section 112 reclamation permit by May 16, 2007.
Y `~ ~ 1
DATED this ~ day of ~ , 2007.
FOR THE CO1LORADO MIN/ED LAND /R/ECL. , ATION BOARD
i I / ~'~f 1 ! /~'~ 1 ' .
l~raeger-Rovdy, Chai ,Mined
amation Board
Colo.
