M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> final constructed ponds. At Pond 011 instead of an open channel spillway as designed for the <br /> emergency spillway, three culverts were installed at approximately the center of the north side <br /> slope. Instead of one(1) 4" weep hole as designed,the principal spillway had two (2) six" gated <br /> intakes below the principal spillway discharge elevation. The gated intakes were constructed <br /> such that they would discharge through the same discharge pipe as the riser. Likewise Pond 013 <br /> with regard to the emergency and principal spillways was constructed in the same manner as <br /> Pond Ol 1. Pond 013 was constructed considerably larger than the approved design. Pond Ol 1 <br /> appeared to be constructed to the approximate size of the design plans. From a visual inspection, <br /> at both pond locations the critical elevations including dam height, emergency and principal <br /> spillways, and freeboard above the emergency spillway all appeared to be adequate with regard to <br /> the requirements of Rules 4.05.6 and 4.05.9. <br /> Ponds 011 and 013 were constructed significantly different from the approved designs. For this <br /> reason, in addition to the construction certification reports, please also submit detailed as-builts <br /> for Ponds 011 and 013 which clearly demonstrate compliance with applicable regulations. <br /> Support Facilities <br /> The shop, warehouse and storage areas were viewed. These locations had been mostly cleared of <br /> snow. These facilities and perimeter areas of the site appeared to be maintained and no problems <br /> were identified. <br />
