III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> immediately to the south of the east end of the construction dirt stockpile. Ditch maintenance is necessary to <br /> clear out the obstruction and restore the original ditch cross section in this location. <br /> SAE silt fence structures appeared to be properly maintained and functional. <br /> Topsoil <br /> The cheatgrass infestation on the topsoil stockpile was sprayed with Round-up herbicide last fall. <br /> Treatment appeared to have been effective, there has been no cheatgrass germination subsequent to <br /> herbicide application. Seeding with the stabilization seedmix will need to be undertaken this fall. <br /> Support Facilities <br /> The operator has encountered poor roof conditions and high ash coal in recent weeks, and there are large <br /> quantities of high ash coaly material stockpiled in the coal yard area and in the sediment drying area near the <br /> sediment pond. Storage capacity in both of these locations appears to be full. The operator recently submitted <br /> a minor revision application to expand the size of the sediment storage stockpile area. The Division issued an <br /> approval decision on December 3, but implementation of the storage area expansion approval is <br /> contingent upon submittal of additional bond in the amount of$6,740.00. The approved permit requires <br /> submittal of a technical revision plan for a permanent coal mine waste disposal area in the McClane <br /> Canyon permit area prior to the end of 2007. <br /> It was noted that coaly material had been pushed to the edge of the containment berm along the east side of the <br /> sediment storage pile location. The material needs to be pulled back or the berm built up as necessary to <br /> prevent sloughage outside the berm. <br /> The area of the construction dirt stockpile that was recently disturbed and graded will need to be <br /> seeded (following any additional disturbance associated with berm maintenance in the sediment drying <br /> area). <br /> I hiked up the reclaimed light use road along the North Fork of Munger Creek to the reclaimed drill pad location. <br /> The Drill pad was regraded and seeded in January 2006. An excellent stand of seeded vegetation has become <br /> established across the site. Species observed include slender, thickspike, and bluebunch wheatgrass, <br /> bluegrass, basin wildrye, green needlegrass, Indian ricegrass, rubber rabbitbrush, big sagebrush, four-wing <br /> saltbush, winterfat, Rocky Mountain penstemon, Palmer penstemon, and blue flax. Due to the extent of <br /> vegetation cover, soil roughness, woody debris and litter, there is essentially no erosion. The extent of bare <br /> ground appears to be lower than on adjacent undisturbed slopes. Silt fencing at the drill site was intact and <br /> functional, but based on the extent of cover and observed lack of erosion, continued maintenance of the silt <br /> fencing does not appear to be warranted. <br /> Seeded vegetation is also becoming established along the reclaimed light use road downstream of the drill pad <br /> area, and no problems were noted. <br /> 4 <br />
