III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> straw and seeding of soil filled gullies). When I departed the site on the afternoon of the 19'h, the crew had <br /> headed back up the reclaimed portal access road to perform the erosion repair and spot reseeding work. Mr. <br /> Brandstadt indicated he would check with his superiors regarding the mulch crimping issue. <br /> I had not been notified as to whether the mulch crimping had been completed or not prior to my follow-up <br /> inspection on November 29. There were no vehicles parked at the end of the road (below the fenced reclaimed <br /> road segment)at 9am on the 29th, and it did not appear that the mulched area just inside the fence had been <br /> crimped, so I assumed that crews were not on site and the crimping project had not yet been initiated. As a <br /> result, I did not hike up the reclaimed portal access road on the 29t , I did hike the four mile round trip up the <br /> North Fork of Munger Creek along the reclaimed light use road to the reclaimed drill site in the McClane Canyon <br /> Mine permit area. I arrived back at my vehicle at approximately 1:30 p.m. There were no vehicles present and I <br /> made the assumption that the mulch crimping project had not been undertaken. As a result, I did not hike up the <br /> reclaimed access road to the portal area; my reasoning being that I would undertake that hike once I had been <br /> notified that the crimping project and erosion repairs had been completed. <br /> Offsite Support Facilities <br /> The Loma Loadout was inspected and the following observations were made: <br /> • Site conditions were dry. Soil surface is stabilized by a mix of winter and summer annuals, as well as <br /> perennials including western wheatgrass, seepweed, greasewood, fourwing saltbush, and forage kochia. <br /> • The SAE silt fence had been properly replaced prior to my inspection of 11/29/07. <br /> Miscellaneous Reclamation Notes <br /> • Segments of the old "elephant trunk"culvert outlets are still scattered along the toe of the slope below <br /> the reclaimed portal access road, and need to be gathered up and hauled out for proper disposal. <br /> • In one location, segments of fiberglass tubing used for an upper road culvert outfall remain on the slope <br /> below the backfilled road. The tubing needs to be removed and properly disposed of. <br /> • Wooden power poles are stacked along the lower road, west of the Munger Creek culvert, and will need <br /> to be hauled out for proper disposal. <br /> 5 <br />
