III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Comments <br /> This was a complete inspection of the Munger Canyon Mine, including Loma Loadout, mine site in Munger <br /> Canyon, and office records at the McClane Canyon Mine office facility. I was not accompanied by an operator <br /> representative. On the initial site visit November 19, 1 inspected Loma Loadout, disturbed areas in Munger <br /> Canyon including the reclaimed portals area and access road, and lower portion of the reclaimed drill site light <br /> use road up the North Fork of Munger Creek. During the follow-up visit on November 29, 1 again inspected the <br /> Loma Loadout, portions of the disturbed areas in Munger Canyon (but not the reclaimed portal area and upper <br /> portions of the reclaimed portal access road), and the entire length of the reclaimed drill pad light use road. I <br /> also reviewed records on file at the mine office. <br /> Weather on 11/19 was clear and mild; site conditions were dry. On 11/29 weather was cloudy and cool; site <br /> conditions remained dry. <br /> Availability of Records <br /> Required records were on file and up-to-date through the 3rd quarter, 2007; see Records form attached. <br /> Roads <br /> Permanent seeding and straw mulching had been completed just prior to my inspection on November 19, along <br /> the fully reclaimed canyon road segment and along the sides of the reduced width valley road segment. I walked <br /> the length of the upper road segment to the Portal Bench area on the 19tn <br /> I walked the entire length of the reclaimed drill pad light use road up the North Fork of Munger Canyon through <br /> the Munger permit area on the 29th. This road segment was reclaimed and reseeded in April 2006. The <br /> reclaimed road segment appears to be stable along the entire length, and perennial vegetation is becoming <br /> established. High densities of small big sagebrush seedlings were observed in numerous locations. There are <br /> weedy species, particularly cheatgrass and whitetop present in some areas, but these species are present in <br /> high densities along the undisturbed road corridor adjacent to the reclaimed road, and were present prior to <br /> construction. <br /> Also, I walked up the reclaimed temporary road along the South Fork of Munger Creek(reclaimed in association <br /> with power line removal)on the 19tn. It was evident that seeding of the permanent mix had been completed. <br /> Mulching was not conducted but was not warranted, as there was significant remnant soil cover from litter and <br /> brush along the narrow corridor. <br /> Hydrologic Balance <br /> Site conditions were dry. There was a small flow in East Salt Creek on 11/19, but no flow in the creek on 11/29. <br /> Munger Creek was dry on both dates. <br /> The silt fence at the lower road topsoil stockpile reclamation site SAE had functioned properly and was in good <br /> condition. The waste disposal area sediment pond was dry, with sediment level approximately 15" below the <br /> primary discharge inlet level. Ditches, culverts, and berms associated with the reclaimed waste disposal site, <br /> cover soil stockpile site, waste area topsoil stockpile site, and lower road topsoil stockpile site had functioned <br /> well and were in good condition. <br /> Silt fence installations on the reclaimed mine bench area were intact and functional. <br /> 3 <br />
