M-1982- <br />,~~~ ~1~12 /j <br />,' ~ ~_~' <br />~~ Dear Mr. Hunt: <br />Upon review of our records, the Division of Reclamation, Mining and Safety found that <br />the Corporate Surety held by Travelers Casualty and Surety Company of America <br />(number 19 S 103509947 BC) in the amount of $28,900.00 was cancelled on January 20, <br />2006. An inspection of this site conducted by the Division of Reclamation, Mining and <br />Safety on September 4, 2007 revealed disturbance of approximately 20 acres. <br />Due to the cancellation of the Corporate Surety, the Division believes this action is in <br />violation of the Act as follows as well as the following Rule: <br />• CRS 34-32.5-117(6)(a) and Rule 4.1(7) for failure to maintain financial <br />warranty in good standing for the entire life of a permit issued under the this <br />article (the Act) and these Rules. <br />Therefore, the Division has found reason to believe a violation exists to DRMS Permit <br />M-1982-112 and the Law and has scheduled this matter before the Mined Land <br />Reclamation Board. <br />A Formal Public Hearing will be held during the January 9th and 10th, 2008 Board <br />meeting for consideration of a possible violation. The hearing will be held in Room 318 <br />of 1313 Sherman Street, Denver, Colorado beginning at 9:00 a.m. on January 9th and 10th <br />or as soon thereafter as the matter can be considered. At that hearing you will have the <br />opportunity to be represented and heard. It will be reiterated that there is reason to <br />believe that you are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order, <br />assess a Civil Penalty in the amount of $100.00 to $1,000.00 for each day of violation, <br />and/or order the permit be suspended, modified or revoked.
